Guidelines for Information Disclosure and Retrieval of Xianyu Store Operating Entities

If you purchase counterfeit or infringing goods on the Xianyu platform and want to safeguard your rights, the first step is to disclose the business entity of the store. If you are a consumer, you can request the disclosure through the customer service of the Xianyu platform. If you are the right holder, you usually need to disclose the information through offline channels. This article will provide a step-by-step guide on how to apply offline for the business entity information of Xianyu stores.

The materials that need to be prepared include: materials for filing a lawsuit, authorization materials for lawyers (law firm letter, power of attorney, lawyer's certificate (for two lawyers)), screenshot materials of the platform's reply refusing to provide the information when requested, and if a large number of information needs to be retrieved, a list of accounts that need to be retrieved should be provided. Among them, the materials for filing a lawsuit generally include a statement of claim (with the Xianyu platform as the defendant), evidentiary materials, and proof of the plaintiff's subject qualification, etc.

Bring the prepared materials to the Future Science and Technology City Court in Yuhang District, Hangzhou. After the court staff have reviewed the materials, they will issue an investigation assistance letter for pre-litigation investigation on the spot. Then, with the investigation assistance letter, go directly to Area A of the Alibaba Xixi Park, which is not far away (about a ten-minute walk), and apply for retrieving the business entity information of the store.

Since the park is very large, the investigation assistance reception hall for retrieving evidence can be entered through Gate A3. There is a registration office in the guard room. Show your ID at the registration office, register, and get a card. Enter the park with the card. The lady at the registration office will kindly ask you to take a photo of the route guide to help you find the investigation assistance reception hall after entering the park.

According to the detailed instructions of the route guide, find the handling window. First, scan the QR code with WeChat to download DingTalk. Fill in the relevant information and get a number. Wait for the staff at the window to call the number. The staff will push a link through DingTalk. Upload materials such as the statement of claim, lawyers' practicing certificates (for two lawyers), and the court's investigation assistance letter as required by the link. Then, wait for the staff to review. After the review is correct, you can go back and wait for the entity information pushed by DingTalk. Generally, the information that needs to be disclosed can be received within three to five working days. Figure 1 is a screenshot of the DingTalk notification interface when we went to the site for disclosure on December 31, and Figure 2 is the disclosed information received on January 3. The efficiency is relatively high.

 

Overall, from obtaining the investigation assistance letter from the court to retrieving evidence at Alibaba, if there are not many people and there is no need to queue, the whole handling process will take about an hour. A morning or an afternoon is quite sufficient.
