Guidelines for Patent Declaration of Financial Aid Research Projects

On January 14, 2024, the National Intellectual Property Administration, the Ministry of Science and Technology, the Ministry of Finance, the National Natural Science Foundation of China, the State Administration of Science, Technology and Industry for National Defense, and the Equipment Development Department of the Central Military Commission jointly issued the "Implementation Plan for Establishing a Declaration System for Patents Formed from Scientific Research Projects Financed by Fiscal Funds". It is required that when the entities or individuals undertaking scientific research projects financed by fiscal funds apply for patents for scientific research projects funded by fiscal funds, they need to declare in the patent business handling system of the National Intellectual Property Administration information such as the type of the project on which the patent application is based, the project name, and the project number. Patents of scientific research projects funded by fiscal funds that have not been declared shall not be regarded as the achievements for project completion acceptance.
I. Who Has the Authority to Operate
- With an agency: Only the agency can make the declaration.
- Without an agency: The applicant shall operate by themselves.
- Information confidentiality: The declared content is only visible within the government and will not be publicly disclosed.
II. Information Required for the Declaration
- Patent application information: Application number, application name, applicant.
- Project information: Project type, project name, project number.
III. What Types of Projects Require Declaration
Some scientific research projects invested by the central fiscal funds, including national science and technology major projects (including major projects of Science and Technology Innovation 2030—major projects, follow-up major projects, major projects facing 2035, etc.), key special projects of the National Key Research and Development Program, national scientific research projects such as projects of the National Natural Science Foundation of China, as well as scientific research projects for national defense and military construction.
Note:
- For other types of projects, the specific project type name needs to be filled in.
- In the future, depending on the operation of the system, research will be conducted to gradually expand the scope of projects to scientific research projects of other central departments and scientific research projects funded by local fiscal funds. If the scope of scientific research projects funded by fiscal funds that require declaration is adjusted, the National Intellectual Property Administration will, in conjunction with relevant departments, promptly announce it to the public.
IV. Declaration Time
- New applications: Declare after the patent is accepted.
- Already authorized patents: Declare voluntarily.
Special Notes:
- Each patent of a scientific research project funded by fiscal funds can only declare the information of one scientific research project funded by fiscal funds. If it involves multiple scientific research projects funded by fiscal funds, only the project information of its main source of funding needs to be declared.
- Since the declared information is only for internal government use, after the declaration is successful, the applicant can only obtain a web page screenshot of the patent business handling system. If there is an error in the declared information, the previous declaration can be revoked and the information can be filled in again.
